Council is proposing to discontinue a section of unused road located at Trythall Street in Beaconsfield and transfer to DEECA at a nominal cost of $1.
The Local Government Act 1989 outlines that Council can change the status of a non-government ‘road’ to a ‘lot’ though a road discontinuance process, to enable abutting landowners to purchase part, or all, of a road, which is then generally required by council to be consolidated into their land parcel.
An application for Council to discontinue a 375m2 section of unmade road and request to have this transferred to DEECA was received by DEECA the abutting landowner.
After an initial inspection, internal referral, and external referral to service authorities, Council has determined that the 375m2 section of Trythall Street will be sold to an abutting landowner, being the Department of Energy, Environment and Climate Action (DEECA) for $1, understanding the future benefit derived from its incorporation within the future Cardinia Creek Parklands project.
The proposed buyer and abutting landowner has accepted terms outlined in a letter of intent, where they have agreed to reimbursing Council with associated costs involved in the discontinuance of the road and sale, including surveying services, lodgement, Public Notices, and legal fees.
Prior to completing the road discontinuance and sale process, council will undertake appropriate engagement and consultation with the community in line with S114 of the Local Government Act 2020 and S223 of the Local Government Act (LGA) 1989. Submitters under s.223 of the 1989 Act have a right to be heard by Council in relation to their submission.
