ACCC urges businesses to remove unfair contract terms before law changes.

Australian businesses must review and modify unfair terms in their standard contracts by November 9, 2023.

The new Australian Consumer Law prohibits unfair contract terms with consumers and other businesses. Courts can penalise entities using such terms. The law will also cover more small business contracts, specifically those with fewer than 100 employees or an annual turnover below $10 million. The contract value threshold will be removed too.
