About
In 2004 the subject land was rezoned for residential purposes to facilitate controlled urban growth of the Garfield township consistent with the Garfield Township Strategy 2002. Development Plan Overlay - Schedule 6 (DPO 06) was also applied to the land to ensure all relevant matters were considered prior to development of the land.
There have been two previously approved Development Plans for DPO 06 Garfield Township (west):
- Area 1: Garfield Township Site-specific (14 Barker Road) Development Plan April 2016 was approved by Council on 4 April 2016. This Development facilitated development of an area now known as Oreti Court.
- Area 2: Garfield Township Development Plan August 2020 was approved by Council on 17 August 2020. This Development Plan facilitated development of an area now known as Sleeper Rise.
Council received an application to amend the existing Area 2 Development Plan to facilitate development of 405 Railway Avenue. Council officers have decided that a new Development Plan should include properties 88, 90, 92, 94, 96 and 405 Railway Avenue and this area will be known as ‘Area 3 South’. Preparation of this Development Plan is a statutory requirement under DPO 06 and must be approved by Council before these properties can lodge a planning permit application to subdivide or develop.
DPO 06 requires a Development Plan to include the following:
- subdivision layout of the land.
- staging of the development.
- relationship of the land to existing or proposed development on adjoining land to achieve the integrated subdivision of land in the area.
- a range of lot sizes and lot development criteria consistent with Garfield Township Strategy (August 2002).
- identification of any remnant vegetation on the land and adjoining road reserve, and measures to provide for the protection and conservation of the vegetation.
- identification of any noxious and environmental weeds on the land and adjoining road reserve and measures to control the weeds.
- identification of areas for revegetation with indigenous species as part of the subdivision of the land.
- infrastructure required to service the development of the land and arrangements for the provision of the infrastructure including access to the development from a sealed road, and provision of pedestrian linkages.

Council has committed to engage with landowners and affected stakeholders to help ensure that the plan reflects local priorities and practical considerations.

- To share information about the Draft Development plan and the requirements of the Cardinia Planning Scheme, particularly DPO 06.

FAQs
A Development Plan is a document which guides the future development of a particular area. It may include requirements around subdivision, vegetation management, roads and shared paths, lot sizes and many other factors depending on the requirements of the Development Plan Overlay which applies to the area.
Development Plan may be prepared and approved in stages. For the DPO 06 area in the western part of Garfield Township the following areas already have approved development plans:
- Area 1: Garfield Township Site-specific (14 Barker Road) Development Plan April 2016. This Development facilitated development of an area that is now known as Oreti Court.
- Area 2: Garfield Township Development Plan August 2020. This Development Plan facilitated development of an area that is now known as Sleeper Rise.
- 88 Railway Avenue (Lot 1, TP400269)
- 90 Railway Avenue (Lot 1, TP744685)
- 92 Railway Avenue (Lot, LP8091)
- 94 Railway Avenue (Lot 1, TP082489)
- 96 Railway Avenue (Lot 3, LP8091)
- 405 Railway Avenue (Lots 4, 5, 6 & 7, LP8091)

- Area 3 (south): is the land that is subject to the currently proposed Development Plan.
- Area 3 (north): a future Development Plan will be required to be prepared and approved before this area can be subdivided and developed.
- Area 4: a future Development Plan will be required to be prepared and approved before this area can be subdivided and developed.
The Draft Development Plan consists of written text, plans and drawings and respond to the requirements of DPO 06, which includes the following topics:
- subdivision layout of the land.
- staging of the development.
- relationship of the land to existing or proposed development on adjoining land to achieve the integrated subdivision of land in the area.
- a range of lot sizes and lot development criteria consistent with Garfield Township Strategy (August 2002).
- identification of any remnant vegetation on the land and adjoining road reserve, and measures to provide for the protection and conservation of the vegetation.
- identification of any noxious and environmental weeds on the land and adjoining road reserve and measures to control the weeds.
- identification of areas for revegetation with indigenous species as part of the subdivision of the land.
- infrastructure required to service the development of the land and arrangements for the provision of the infrastructure including access to the development from a sealed road, and provision of pedestrian linkages.
The Draft Development Plan seeks to anticipate the requirements of the Federal EPBC Act 1999 which will be triggered later in the development process.
The Draft Development Plan seeks like for like replacement of any removal of SBB habitat in strategic locations that form habitat corridors to assist movement and protection of the SBB.

As a stakeholder, you are invited to submit written queries and comments to the Planning Strategy Team for consideration.
It is important that you provide your feedback now. Once a Development Plan is approved all future planning permit applications will not be required to give public notification if the proposal generally accords with the approved Development Plan.
A Development Plan must comply with the requirements of the Cardinia Planning Scheme. If a submission seeks changes that do not comply with the requirements of the Cardinia Planning Scheme these changes will not be able to be included in the final Development Plan.
Yes, landowners within and adjoining the Garfield Township (west) Development Plan area will be notified in writing about the Council Meeting date when the Development Plan will be presented for approval, as well as when the Council Meeting Agenda will be available.
Following Council approval of the final Development Plan, the timing of development is at the discretion of the landowners.
