About Amendment C249
Amendment C249 corrects a number of minor zoning and overlay anomalies in the Cardinia Planning Scheme. It applies to various sites throughout the Shire. The corrections provide clarity, ensure that appropriate land uses and development occurs across the Shire, ensures important sites are recognised and protected, and that planning permit applications are being assessed against the appropriate planning provisions.
The Amendment achieves the following:
- Rezoning properties to a zone that more appropriately reflects the current and future land use of that property.
- Removes a heritage overlay on a property that no longer contains any significant heritage elements.
- Amends the mapping of several Heritage Overlay references to more accurately reflect the location of significant properties.
- Amending the incorporated document "Cardinia Local Heritage Study Review, Volume 3: Heritage Places and Precinct citations (December 2020)" to ensure the map, property addresses, property information and heritage grading of properties within Bunyip, Garfield and Koo Wee Rup commercial precincts are correct.
Given this Amendment is administrative in nature, an internal memorandum was signed on 9 October 2019 by the General Manager Liveable Communities under delegation to seek authorisation from the Minister for Planning for the authorisation of Planning Scheme Amendment C249 under the provisions of 20(2) of the Planning and Environment Act 1987.
The Minister for Planning granted authorisation on 1 November 2019.
Amendment C249 was on limited exhibition from 4 June 2020 to 3 July 2020.
Submissions for Amendment C249 closed at 5pm on Friday 3 July 2020.
Submissions were not received; therefore, a report to Council was not required.
At the Council meeting on 17 August 2020, Council resolved to adopt Amendment C249.
Amendment C249 was approved with changes.
